A businessman has been arraigned before the Nsangi Chief Magistrate’s Court on charges of land fraud and forgery after he allegedly used property belonging to another person as collateral to secure a bank loan.
Kamya Gordon Mustafa, a resident of Nsangi, appeared in court following a joint operation by the State House Anti-Corruption Unit, the Office of the Director of Public Prosecutions (ODPP), and the Criminal Investigations Department (CID). Prosecution alleges that Mustafa fraudulently obtained a land title for property owned by Mr. Higenyi Jackson and used it to acquire a loan from Post Bank.

According to investigations, Mr. Higenyi lawfully purchased the land located in Kitemu in 2005 and constructed a storied building known as Nebanda House, which he later rented out to tenants. In 2019, Mustafa purchased an adjacent plot and reportedly obtained the parent title from the registered owner with instructions to subdivide and create a title only for the portion he had bought. However, prosecutors contend that instead of processing a title for his rightful share, Mustafa transferred the entire land — including Mr. Higenyi’s portion — into his name and subsequently subdivided it into three separate plots.

Further investigations revealed that in 2023, Mustafa secured a loan of UGX 60 million, using the contested property as collateral. To support his loan application, he allegedly submitted photographs of Nebanda House, including one showing him standing next to the building while falsely claiming ownership.

Mustafa has been charged with obtaining credit by false pretences and fraudulent creation of a certificate of title. The case has been adjourned to December 2, 2025, when the accused is expected to reappear before court.
